Personal Injury
The case may involve an auto accident with a fairly straight-forward set of records and injuries. However, after compiling a time-line of the medical treatment and drug prescription types and dosages, it may become apparent that the victim has now become addicted to pain medicine. That would change consideration of damages to remove that addiction.
Medical and Nursing Malpractice
The review for merit and meeting the four elements of malpractice is key to saving the attorney time and allowing him to focus on the key elements of the case. After that our medical detective work starts. For example, if the patient had an IV infiltrate, burning the skin and tissue down to the tendon with chemicals, the question would be why? The need for the IV calcium is not caused by the thyroid surgery, unless the parathyroid was damaged in the surgery. Did the patient sign an operative permit that listed this as a possible complication? Our medical detective work looks beyond the obvious and can lead to additional defendants or additional defenses.
General Negligence
A waitress carrying a tray of dishes may slip on water at the top of the steps and tumble down several feet, wrenching her back. Was the water the cause of her back problems? Or was that a pre-existing condition? Was she on medicine that might have caused her to lose her equilibrium?
Product Liability
An infant in his crib with a pacifier, chokes and dies. Investigation shows the pacifier came apart releasing the liquid and a small part that was caught in his throat. Current and previous medical records are important in showing additional possibilities or ruling those out.
Toxic Torts
Asbestos may be accused of causing severe life-threatening diseases in a class-action case involving 50 plaintiffs. Medical records may hold the key to pinpointing the cause in some or all plaintiffs . . . or those records may point to other causes in some of the cases.
Workers' Compensation
A severe foot injury may be obvious, but the attorney may need our firm's illustrations and key points to help him understand the case for preparing questions in depositions or hearing presentation. In other cases, our firm can help spot malingering which is intentionally deceptive behavior.
Criminal
Medical charts are involved in many types of criminal cases such as rape, assault, or murder. In a DUI case, for example, the report on the driver (your client) showed a significant level of morphine. Guilty of heroin use? Maybe not if our firm finds the drug testing occurred in the emergency room after the driver/patient had been given morphine as part of the treatment.
